CAN-SPAM Act of 2003
A new US Federal anti-spam law was put in place on January 1, 2004 to protect Internet users against the grossest form of spam. This federal anti-spam law supercedes all existing anti-spam legislation in 36 states.

Email Express Direct fully supports the adoption of the CAN-SPAM law as it is an important first step in combating spam. It is important to understand that anti-spam legislation is intended to stop spammers, not legitimate permission-based email marketers like you.

The CAN-SPAM Act of 2003 affects all businesses in the US that are using email to promote products and services. CAN-SPAM is an opt-out law, which means that if a recipient wants to unsubscribe or opt-out from the list this request must be honored or be subject to severe penalties. The law also provides provisions (penalties and possible imprisonment) for misleading commercial email broadcasts. Overall this legislation makes it illegal to send misleading email communications and easier for legitimate email marketers to comply with a single set of laws.

In short, the CAN-SPAM law:
  Prohibits the presentation of misleading information in the subject line, from field, headers, return addresses, etc. Use a subject line that accurately reflects the content of the message, a legitimate message header and valid From address. Email Express Direct already automatically sets up your header information and allows you to broadcast email messages using your own, validated email address.  
  Requires that the sender’s valid, physical address and working phone number be clearly listed in the content of the email message. Although Email Express Direct automatically adds the physical address and phone number from information provided by the account owner to every email broadcast, it is the account owner’s sole responsibility that a clearly marked valid physical mailing address and phone number is included in all email campaigns.  
  Requires that the email broadcast system operates a working unsubscribe system with clearly marked unsubscribe link and instructions that makes it easy for recipients to unsubscribe from the email address list for up to 30 days after the broadcast date. Email Express Direct automatically adds an unsubscribe link to each email message and manages the unsubscribe requests automatically.  
  Implicates not only spammers, but also those who procure their services.  
  Requires that all commercial, promotional email messages are clearly marked is advertising, unless recipients have previously opted in. As an Email Express Direct account owner you are already using strictly opt-in email lists.  
  Criminalizes transmission of sexually-oriented e-mail messages without clear markings.  
  Makes it illegal to send email messages to e-mail addresses that have been harvested from websites.  
  Includes both criminal and civil penalties and allows suits by the Federal Trade Commission (FTC), State Attorneys General, and Internet Service Providers.

Policy For Adding Subscriber Lists
Email Express Direct allows account owners to import email address lists for use with email broadcasts initiated from Email Express Direct. These email addresses must be opt-in email addresses. An opt-in email address is one which is acquired through a sign-up form in a physical store or web site, through business cards or previous purchases from business acquaintances or other personal and business relationships.

Forms of email address acquisition that are not accepted are:
  The use of email address lists acquired through harvesting technologies.  
  The use of purchased lists from any source.  
  The use of non-specific email addresses (sales@company.com, info@company.com, support@company.com).  
Importing of email addresses that violate the Policy For Adding Subscriber Lists will make your Email Express Direct account subject to immediate termination.
